Pravo u Crnoj Gori

Pravo u Crnoj Gori uređuje odnose između ljudi, poduzeća, javnih tijela i drugih organizacija. Njegova glavna područja uključuju rad, imigraciju, kaznena djela, potrošačke transakcije i pitanja privatnog prava kao što su ugovori, imovina, obitelj i nasljeđivanje. O tim pitanjima odlučuju različita tijela, uključujući sudove, ministarstva, policiju, regulatore, javne bilježnike i javne izvršitelje.

Immigration law

Montenegro's immigration law regulates entry, visas, residence, work, international protection, permanent residence and citizenship for foreign nationals. A C visa generally permits up to 90 days in any 180-day period, while a D visa covers stays over 90 days for specified purposes such as work, business and digital-nomad activity. Longer stays require a purpose-based status such as temporary residence, a temporary residence-and-work permit or a protection status. The Ministry of the Interior and police handle most residence procedures, while the Ministry of Foreign Affairs handles visas through diplomatic and consular missions.

Criminal law

Criminal law in Montenegro sets the rules for criminal offences, personal guilt, investigations, trials, sanctions and the rights of accused, convicted and harmed persons. A criminal offence, called krivično djelo, must be defined by law and committed unlawfully and culpably. The system covers ordinary offences, organized crime, corruption, road offences, digital offences and offences involving children.

Consumer protection

Consumer protection in Montenegro gives private consumers rights when they buy goods, services, financial products, travel arrangements or digital offers from traders and professional providers. The current framework is based on the Law on Consumer Protection, Official Gazette of Montenegro No. 12/2026, in force since 14 February 2026. It covers product information, conformity, unfair practices, withdrawal, complaints, sector regulators and protection against fraud. Responsibilities are shared between national authorities, sector regulators, local administrations and providers.

Civil law

Civil law in Montenegro governs legal relationships between private persons and organizations. It covers legal capacity, contracts, property, family, inheritance, liability, court proceedings and enforcement. Montenegro uses several substantive and procedural laws rather than one unified Civil Code. Courts, notaries, the Real Estate Administration, public enforcement officers, social work centers and the Center for Alternative Dispute Resolution perform the main public functions.
