The President is head of State, guarantor of the Constitution and institutions, Supreme Commander and a participant in forming the Government. The President is elected by popular vote for five years, appoints the Prime Minister in accordance with the parliamentary majority, promulgates laws and has constitutional veto powers. As of September 2026, José Ramos-Horta is President and Kay Rala Xanana Gusmão is Prime Minister of the IX Constitutional Government. The Parlamentu Nasionál is unicameral, is elected for five years and has between 52 and 65 seats. It passes laws, approves the State Budget, exercises political oversight and performs constitutional functions concerning treaties and public institutions. The Government directs executive administration through the Prime Minister, the Council of Ministers and ministries. Courts are independent. Until higher courts are installed, the Court of Appeal exercises the powers of the Supreme Court and of the High Administrative, Tax and Audit Court.

The República Democrática de Timor-Leste is a democratic, sovereign, independent and unitary republic governed by the Constitution promulgated in 2002. The President, the unicameral Parlamentu Nasionál, the Government and independent courts divide the main powers of the State. Public authority operates through national ministries, territorial administration and community structures, while the State budget finances public functions and petroleum revenue is managed through the Petroleum Fund.
