Labor law
The Code du travail sets the main rules for dependent work in the Republic of the Congo. It covers employment contracts, pay, working time, leave, workplace safety, collective representation, disputes and termination. The framework generally applies to workers of every nationality and to public and private employers, but not to permanent civil servants.
Immigration law
Immigration law in the Republic of the Congo governs entry, residence, work, study, family ties, protection status, naturalization, and the consequences of refusal or expulsion. National rules apply to Congo-Brazzaville and must not be equated with the law of the Democratic Republic of the Congo. Depending on the procedure, responsible authorities include immigration offices, the Ministry of the Interior, Congolese diplomatic missions, CNAR, and ACPE.
Criminal law
Criminal law in the Republic of the Congo governs criminal offences, investigations, criminal proceedings, sanctions, and the rights of accused and injured persons. Its foundations include the Constitution of 2015, the Penal Code (Code pénal), and Law No. 1-63 on criminal procedure (Loi n°1-63). The judicial police, National Gendarmerie, public prosecutors, and courts share responsibility from the initial report through appeals.
Consumer protection
Consumer protection in the Republic of the Congo safeguards private consumers when they buy goods, use services or sign contracts with professional suppliers. Loi n°36-2024 protects information, quality, safety, economic interests, privacy, repair, withdrawal and access to courts or dispute resolution. The most practical safeguards concern prices, invoices, product labels, delivery, defective goods, distance contracts, financial services, telecommunications and complaints.
Civil law
Civil law in the Republic of the Congo governs private legal relationships between people and organizations, including contracts, property, family matters, inheritance, liability, court proceedings and enforcement. The legal basis is spread across several laws and legal instruments; depending on the case, the civil code and family code, land, procedural and OHADA rules apply. Depending on the matter, the responsible authorities may include courts, notaries, bailiffs, civil-status authorities and the land administration.
