Employment in Poland

In Poland, employment can be based on an employment contract or on a civil-law contract. The main employment contract is called umowa o pracę, while common civil-law forms are umowa zlecenie and umowa o dzieło. An umowa o pracę creates an employee relationship. The employer directs the work, provides the workplace or tools when needed, and pays agreed remuneration. The employee performs the work personally and follows reasonable workplace rules. An umowa zlecenie is usually used for carrying out specified activities or services. It can be more flexible than an employment contract, but it does not normally provide the full set of employee protections. An umowa o dzieło concerns a specific result, such as creating a finished work. A written agreement should identify the parties, work or service, pay, place, and important conditions. Before starting, a worker should understand the language, working time, payment method, and how the agreement can end. Employees under an umowa o pracę receive protections connected with working time, rest, leave, safety, and ending the employment relationship. Civil-law contracts follow different rules, so their protections depend more strongly on the agreement and applicable general law. Pay is normally discussed as brutto, meaning before deductions, or netto, meaning the amount received after deductions. Taxes and social insurance can reduce the brutto amount, and the exact result depends on the person and contract. People working in Poland may also need documents connected with identity, tax, social insurance, or the right to work. A foreign worker should check these matters before beginning work and keep copies of all agreements and important messages. Good employment practice includes asking questions early, recording hours and payments, keeping proof of work, and seeking help from an official labour institution or qualified adviser when a serious disagreement arises.
