Law in Maldives

Law in Maldives is the framework of rules governing private relationships, public authority and legal procedures. Its main areas include labor law, immigration law, criminal law, consumer protection and civil law. The applicable rules can change with a person's status, the purpose of an activity, the sector involved and the subject of a dispute.

Tip

Treat a legal issue in Maldives as a classification problem first: identify whether it concerns employment, immigration status, an alleged offence, a purchase or service, or a private relationship. That classification determines the relevant rules, institution and possible consequences. Record the facts, status, dates, documents and location before contacting the responsible authority, and obtain qualified legal assistance when the matter involves criminal exposure, removal, termination, major loss or an uncertain court route.

Labor law

Maldives labor law regulates employment agreements, working time, pay, leave, workplace safety, worker representation, disputes and termination. The Employment Act, the Industrial Relations Act and the Occupational Safety and Health Act apply to most state and private employment, while military and police employment follows separate laws. Rules differ for employees such as expatriates, minors and workers on resorts or other isolated islands.

Immigration law

Immigration law in the Maldives governs entry, visas, residence, work, study, family residence, citizenship and removal. The correct permission depends on the purpose and duration of the stay, and a visa does not guarantee admission. Foreign nationals must keep their passport and permit details valid and leave when their permission expires or is revoked.

Criminal law

Maldives criminal law defines offences, regulates investigations and trials, and sets sanctions and procedural rights. The main framework includes the Penal Code Act 9/2014, the Criminal Procedure Act 12/2016 and the Evidence Act 11/2022, alongside laws on drugs, sexual offences, domestic violence, terrorism, road traffic, children and digital offences. The system includes the Maldives Police Service, the Prosecutor General’s Office and the criminal courts.

Consumer protection

Consumer protection in Maldives covers purchases, services, contracts, digital offers, financial products, travel, energy, health products and fraud. The Consumer Protection Act (Law No. 12/2020), effective since 1 March 2021, gives consumers ways to seek remedies and compensation. The Consumer Ombudsman’s Office provides a general complaint process, while sector regulators handle many specialized disputes.

Civil law

Civil law in Maldives governs legal relationships between private people and organisations, including contracts, property, family matters, inheritance, liability and court proceedings. The system relies on the Constitution, statutes, regulations and Islamic Shariah within the constitutional limits of Article 10. Different courts and authorities handle different matters, so the correct procedure depends on the subject and location.
