Consumer protection in Kenya

Kenyan consumer protection rules apply when people obtain goods or services for personal use. They draw on constitutional consumer rights, legislation, contract principles, sector rules, and standards for products and trade practices. Consumers should receive information that is understandable and not misleading. Important facts may include the identity of the seller, the nature and condition of the item, the total price, important limitations, and the main service terms. Goods should generally be of acceptable quality, reasonably safe, and suitable for an agreed or ordinary purpose. Services should be carried out with reasonable care and according to the agreement. A warranty is a promise about a product or service, but consumer rights do not always depend only on a written warranty. A seller cannot necessarily avoid basic obligations merely by using broad words such as no returns or sold as seen. Misleading advertising, hidden material terms, false descriptions, unsafe products, and certain unfair contract practices can raise consumer issues. Digital sales, mobile payments, delivery services, credit arrangements, and online marketplaces also create records that may help prove a transaction. A suitable remedy depends on the problem and circumstances. It may involve correction, repeat performance, repair, replacement, refund, price reduction, compensation, or cancellation of an agreement. A complaint normally begins with the seller or service provider. If it remains unresolved, a consumer may approach a relevant regulator, the Competition Authority of Kenya, a sector complaint body, an alternative dispute process, the Small Claims Court, or another court with authority. Consumers also have practical responsibilities. They should read key terms, use products properly, protect account credentials, inspect deliveries, report problems promptly, and provide truthful evidence.
