Law in Cambodia

Law in Cambodia is the system of rules governing work, immigration, offences, consumer transactions and private relationships. Its main areas include labor law, immigration law, criminal law, consumer protection and civil law. Different ministries, regulators and courts handle these areas according to the issue involved.

Tip

Start by classifying the problem as labor, immigration, criminal, consumer or civil law, because the responsible authority and procedure may differ. Keep the relevant contract, visa, transaction, complaint or incident records together, and do not assume that one document or authority resolves every part of the matter.

Labor law

Labor law in Cambodia governs dependent work, including employment contracts, working time, wages, leave, workplace protection, worker representation, disputes and termination. The Labour Law 1997 and later amendments apply nationwide to most private and public enterprises, including industry, agriculture, services and transport. The Ministry of Labour and Vocational Training, Labour Inspectors, the Arbitration Council and the courts perform different roles in applying these rules.

Immigration law

Cambodian immigration law regulates entry, visas, residence, work, protection, permanent residence, citizenship and removal. Visitors commonly enter with a tourist Visa T or an ordinary Visa E, while work, study, retirement and job-search stays normally require an appropriate extension of the ordinary Visa E. A visa does not itself grant permission to work or guarantee continued residence.

Criminal law

Criminal law in Cambodia sets the rules for offences, personal responsibility, investigation, prosecution, trial and punishment. Cambodia's Criminal Code, ក្រមព្រហ្មទណ្ឌ, defines offences and penalties, while the Code of Criminal Procedure, ក្រមនីតិវិធីព្រហ្មទណ្ឌ, governs criminal investigations and proceedings. Courts may impose imprisonment, fines in riel and additional measures; life imprisonment is possible, while the death penalty is constitutionally abolished. Victims can seek compensation through a civil action attached to criminal proceedings, but an ordinary complaint does not automatically create that status.

Consumer protection

Consumer protection in Cambodia covers goods, services, contracts and rights in immovable property supplied through business activity in Cambodia. A consumer obtains them for personal, domestic or household use, not for resale, production or commercial use. The Consumer Protection Law 2019 protects information, fair choice, complaints, settlement and compensation through the National Commission for Consumer Protection (NCCP), the Ministry of Commerce's Consumer Protection, Competition and Fraud Repression Directorate-General (CCF), and sector regulators.

Civil law

Cambodian civil law governs private legal relationships between individuals and organisations. The national Civil Code, effective since 2011, covers persons, contracts, property, family, inheritance, liability, civil proceedings and enforcement. The Khmer original is authoritative, while English translations serve only as references. Registration documents, competent authorities and court procedures strongly affect the practical outcome.
