Cambodia's insurance system includes licensed commercial insurers, brokers, agents, loss adjusters and statutory schemes. The Insurance Regulator of Cambodia, known as IRC, under the Non-Bank Financial Services Authority, supervises the market. The Ministry of Economy and Finance provides the legal framework and handles mediation, while the National Social Security Fund, known as NSSF, administers statutory social insurance schemes. Only licensed institutions may conduct insurance business, so the provider's licence should be checked in the IRC registry. Private insurance usually follows this sequence: choose a licensed insurer or broker, compare the proposed cover, sign the policy, pay the premium and notify the insurer when a covered event occurs. General insurance can cover property, liability and health. Life insurance includes products such as term life, whole life, endowment and annuity policies; personal accident and critical illness products are also available. Microinsurance targets lower-income groups. A property policy generally indemnifies no more than the declared value, subject to the policy terms. A liability policy can pay an injured third party, and the insured normally transfers recovery rights to the insurer after indemnity. Statutory access is linked to defined employment or status rather than residence alone. Workers covered by the Labour Law, including domestic, air and maritime personnel, receive compulsory occupational-risk and health coverage through NSSF arrangements. Public employees, former civil servants and veterans fall under statutory NSSF schemes. Self-employed people and NSSF dependants can use voluntary NSSF health coverage under Sub-Decree 280/2023, with the member paying an actuarially determined rate. The NSSF occupational-risk contribution is 0.8% of contributory wages, and the health contribution is 2.6%; since 2018, the employer bears the health contribution for covered employment. The first pension contribution period uses a 4% contribution on contributory wages during the first five years. NSSF benefits can include treatment, referral, daily allowances, employment-injury care, old-age, disability, survivor and funeral benefits. Occupational-risk protection can cover work accidents, commuting accidents and occupational disease, with emergency treatment through an NSSF-recognized facility. Some insurance is compulsory only for activities specified by law or a sub-decree. A business-use motor vehicle, including a trailer, requires third-party liability cover for the owner, driver and maintainer. Construction-site owners must obtain liability cover before work starts. Passenger-transport businesses must cover passenger liability for land, water, air or rail transport. The stated fines range from KHR 15,000 to KHR 1,500,000 for the relevant motor-vehicle offence and from KHR 1,500,000 to KHR 150,000,000 for construction and passenger-transport offences. These rules do not make every private policy compulsory. A policy contract is written in Khmer and must be signed or confirmed by thumbprint. An English explanation can help with understanding but does not replace the controlling Khmer legal text. The contract identifies the insured risks, exclusions, sum insured, deductible, premium, term, beneficiary and claim procedure. The premium must be paid as agreed. Concealing material information or making a material misrepresentation can invalidate the contract, and a willful or fraudulent loss is excluded. Policy effectiveness normally depends on the contractual start date and payment conditions, not merely on receiving a quotation. For a claim, notify the insurer within the period stated in the policy and preserve the policy, premium records, medical documents, police reports, photographs, repair evidence and other proof of loss. A staged or fraudulent accident can lead to refusal of the claim and recovery of amounts already paid. General insurance claims are generally subject to a five-year limitation period. Life claims are generally subject to fifteen years after death, while an additional life policy covering health risks has a five-year period. A complaint normally begins with the insurer, then may proceed to mediation by the Ministry of Economy and Finance, followed by arbitration or court proceedings. After failed mediation, the stated period for starting arbitration or court proceedings is 90 days. No universal public claim fund is evidenced for all insurance losses. Changing or ending cover requires attention to the policy and the applicable Sub-Decree procedure. Both parties may have termination rights before the due date, but policy changes may require insurer approval and revised terms. If a premium is not paid, the insurer gives notice after 20 days and an additional 10-day period may follow before the contract can be nullified. Renewal, cancellation and transfer rules are policy-specific. The Law on Insurance, NS/RKM/0814/021, was promulgated on 4 August 2014 and took effect on 4 February 2015. Its English version published by the IRC is unofficial; the Khmer legal text controls. The law also regulates insurers, including public limited company structures, capital requirements and liquidation priorities for indemnity claimants and policyholders.
