Criminal law in Bolivia

Bolivian criminal law defines offences, criminal responsibility, investigations, court proceedings and sanctions. The Fiscalía leads public prosecutions, while the Policía Boliviana investigates and the courts decide guilt, protective measures and appeals. Accused persons have rights to defence, silence, an interpreter and a presumption of innocence, while victims can report offences, participate and seek protection.

Treat the first contact with the Fiscalía, police or court as a point where your rights and later options can be affected. If you are accused, secure defence, use silence and request an interpreter when needed; if you are a victim, preserve evidence, request protection and decide whether formal participation as a querellante is useful. Do not assume that detention, a public complaint or an indigenous jurisdiction applies automatically.
