The main legal framework consists of the Código Penal, the Código de Procedimiento Penal and special laws on subjects such as corruption, controlled substances, gender violence, trafficking, weapons, the environment and digital offences. A typical public case begins with a denuncia or other notice of an alleged offence, followed by a preliminary investigation, formal imputación, preparatory proceedings and either an accusation, dismissal or an alternative resolution. The case may continue to an oral public trial, an abbreviated procedure or an appeal. A flagrante offence can allow an immediate procedure, but the applicable procedure depends on the offence and the circumstances. The Fiscalía General del Estado directs criminal investigations and brings public charges. Police units perform specialised work through bodies such as FELCC for general crime, FELCV for violence, FELCN for controlled substances, DIPROVE for vehicle theft, POFOMA for environmental offences and Tránsito for road matters. The Instituto de Investigaciones Forenses, known as IDIF, provides medical, genetic, toxicological, ballistic, accident-analysis and digital-forensic services. Evidence must be collected lawfully and protected through a documented chain of custody; evidence obtained illegally or through torture cannot support a conviction. Detención preventiva is a judicial measure and an exception rather than an automatic consequence of an accusation. Depending on the case, a judge may consider reporting duties, travel restrictions, bail, house arrest or detention. The prosecution does not decide a suspect's freedom on its own. Bolivia has no death penalty, and the ordinary maximum custodial sanction is 30 years. Other sanctions include fines calculated by days, disqualification, community work and security measures. A criminal enforcement judge supervises execution, conditional release and other sentence-related decisions under the applicable rules. Victims may report an offence, request information and protection, submit evidence, participate as a querellante and challenge certain decisions. The Fiscalía's specialised protection service can assist victims, witnesses, informants and cooperating officials, while IDIF can provide forensic, medical and psychological support. Compensation for loss is generally pursued through a civil claim or a civil component connected with the criminal case. Children and adolescents are subject to special rules. A child under 14 is not criminally responsible and may receive protective or social measures. A person aged 14 to under 18 falls under the Sistema Penal para Adolescentes, where specialised courts, prosecutors and mandatory free defence apply; restorative justice, diversion and socio-educational measures are prioritised, and detention is a last resort. Bolivia also recognises indigenous-origin campesino jurisdiction when its personal, material and territorial conditions are met. It remains subject to fundamental and human rights, cannot impose a death penalty or justify lynching, and cannot resolve violence against women or children through conciliation. Road offences and digital offences require additional distinctions: the Penal Code regulates dangerous driving, fatal or serious injury in accidents and failure to provide assistance, while provisions on unlawful data access or manipulation and newer child-protection rules address certain digital conduct. Departmental resources and institutional availability can affect practical access, but no uniform general case duration or fee applies to all criminal proceedings; defence through SEPDEP is free for accused persons without sufficient means or a chosen lawyer.
