The main legal framework includes the Constitution, the Criminal Code Act, the Summary Jurisdiction Acts, the Indictable Procedure Act, the Evidence Act, the Bail Reform Act and legislation on drugs, firearms, gangs, money laundering, corruption, trafficking, road offences and cybercrime. The Belize Police Department investigates reports, takes statements, conducts searches and seizures, and works with the Belize Forensic Science Service. The Director of Public Prosecutions advises on and conducts prosecutions in Magistrates’ Courts and the Supreme Court. An arrested person must receive the reasons for the arrest in a language they understand within 24 hours and must generally be brought before a court within 48 hours. The Constitution protects personal liberty, privacy, access to legal counsel, preparation of a defence, witness examination, an interpreter, the presumption of innocence and freedom from compelled trial testimony. A person may seek bail under the applicable law and may challenge unlawful detention through habeas corpus. Proceedings can involve a police charge, a Magistrate’s Court hearing, a preliminary inquiry and, for an indictable offence, a jury trial in the Supreme Court. Criminal appeals go to the Court of Appeal. Possible consequences include fines, imprisonment, life imprisonment or, for murder, the legally available death penalty, as well as forfeiture, property orders and driving disqualification. Courts may impose probation or community service under the Alternative Sentencing Act 2024 when the legal and practical requirements are met. A plea agreement can be discussed before conviction, but the court may accept or reject the recommendation and must protect disclosure, representation and victim-impact rights. Victims can report offences to the Belize Police Department and may participate in relevant prosecution processes. The Protection of Witnesses Act 2022 provides a framework for measures such as anonymity, screening, voice modulation and video evidence, although the operative status of its commencement provision should be verified before relying on it. Family Court and domestic-violence protective-order matters may overlap with criminal proceedings but belong to a different legal pathway. Juvenile criminal matters go to the Family Court under special rules for children under 16 and young persons aged 16 to under 18, including privacy protections, parental or guardian involvement and separation from adult detainees. Road offences are handled mainly under the Motor Vehicles and Road Traffic Act and related insurance legislation. Police and transport officials enforce rules on licensing, registration, roadworthiness, speed, dangerous or careless driving, accidents and driving under the influence; the alcohol limit is 80 mg per 100 ml of blood or 107 mg per 100 ml of urine. Cybercrime law covers illegal access, data or system interference, illegal devices, computer forgery, identity fraud, child luring, private-area image publication, online coercion and related conduct. The Legal Advice and Services Centre may assist with eligible criminal Magistrate’s Court and traffic matters after a means assessment; private counsel costs vary, and public-funded representation is not automatic.
