Labor law in Peru

Labor law in Peru governs the relationship between a worker and an employer. It covers hiring, pay, working time, rest, safety, social protection, discipline, and the end of work. A worker may have an indefinite contract, a fixed-term contract, or another legally recognized form. The correct form depends on the real work, its duration, and the reason for using a special contract. Planilla is the employer's formal payroll register. Being included in planilla helps show that an employment relationship exists and connects the worker with benefits and social protection. Common Peruvian employment terms include remuneración, CTS, gratificaciones, vacaciones, EsSalud, AFP, and ONP. These terms relate to pay, savings or protection when work ends, periodic payments, leave, health care, and pension systems. Employers generally have duties to pay what was agreed, respect rest and leave, prevent unsafe conditions, and avoid discrimination or abuse. Workers generally have duties to perform the agreed work, follow reasonable instructions, protect workplace safety, and act honestly. Problems may involve unpaid wages, missing payroll registration, unsafe work, harassment, discrimination, or an unfair dismissal. A calm written record of dates, messages, payslips, schedules, and witnesses can make the situation easier to understand. Peru has administrative labor oversight through SUNAFIL in many formal employment matters, while courts may decide disputes that require a judicial ruling. Some disagreements can also be addressed through direct discussion or conciliation. The practical limits are important because the result can depend on the contract, the real facts, the worker's category, and the applicable special rules. A person should identify the problem, preserve documents, ask for a written explanation, and obtain qualified local advice before signing a settlement or starting a formal claim.
