Immigration law in Poland

In Poland, a foreign national is commonly called a cudzoziemiec. Immigration rules cover entry, residence, work, study, family life, protection, and departure. EU and EEA citizens generally follow a different system from people who are not EU or EEA citizens. Non-EU nationals may need a visa, a residence permit, or another legal basis for their stay. A short stay and a long stay are treated differently. A person who wants to live in Poland for a longer period may apply for a temporary residence permit, called zezwolenie na pobyt czasowy, or may qualify for permanent residence or another status. A karta pobytu is a residence card that documents certain residence rights. It is important to distinguish the physical card from the underlying decision or legal status. Work, study, business, family reunification, and humanitarian reasons can have different requirements. A work authorisation and a residence right may be separate matters, so one document may not automatically replace the other. Applications are commonly handled by a voivode, called a wojewoda, through the relevant voivodeship office. Border matters may involve Straż Graniczna, the Polish Border Guard, and some national immigration matters involve central authorities. Typical procedures require an application, identity documents, proof of purpose, proof of accommodation or resources where relevant, and sometimes fingerprints or other evidence. The authority may ask for additional documents or an explanation. Immigration law has important limits because small mistakes, missing documents, or an expired status can affect a person’s ability to stay or work. Always check the legal basis of your current stay before changing employer, purpose, or address.
