The local term punëdhënës refers to the employer, while i punësuar refers to an employed worker. A formal employer begins with registration through the Agjencia e Regjistrimit të Bizneseve të Kosovës (ARBK), using an individual business, general partnership, limited partnership, limited liability company, joint stock company, foreign company, representative office or agricultural cooperative. Online requests can cover the name, address, legal form, number of employees, activity, owners, board, capital, representative and cancellation. The owner or an authorised representative uses a verified account, and municipal business centres provide local access to ARBK services. A limited liability company needs at least one managing director and may have a board; a joint stock company requires a board. Foreign businesses and representative offices follow separate registration paths. The employer and worker sign a written employment contract. It can be indefinite, fixed-term or for specific work or duties. The contract identifies the employer, registered seat and business-registration number, as well as the worker's identity, qualification and address. It also states the job title, tasks, workplace, working hours and schedule, start date, duration where relevant, base wage and additions, leave and termination arrangements. An internal act, a Collective Agreement and the contract have to align with the Labour Law. The employer applies equal treatment and equal criteria for the same position during recruitment, training, promotion, working conditions, discipline and termination. Forced labour is prohibited. Employment is prohibited below age 15; workers aged 15 to 18 may perform only light, non-hazardous work. For recruitment, an employer can create an account with the Agjencia e Punësimit e Republikës së Kosovës (APRK). The account uses the business tax number, business name, formation date, business email and an authorised contact. Vacancies can be published through the APRK portal, Zyrat e Punësimit, Qendrat e Aftësimit Profesional and private portals. A useful vacancy record states the region, sector, occupation, education, experience, full-time or part-time status, seasonal character and whether the contract is fixed-term, indefinite or for specific work. Probation may last up to six months; either side can end it with seven working days' notice. Trainees retain normal employment rights. An unpaid internship is possible only with safety measures and proper records, for up to one year after postgraduate or university education and up to six months after secondary education. Recruitment planning also reflects the labour market: in the cited 2024 employment data, trade represented 19.5%, construction 12.6% and manufacturing 10.6% of employment, while youth unemployment was 19.5% and the female employment rate was 21.2%. The employer registers workers through the ATK EDI system of the Administrata Tatimore e Kosovës. New worker data are due one working day before the employment starts and include the start or end date, full-time or part-time status, education, profession and position. A current 2026 notice requires all existing workers to be entered by 31 October 2026, with updates whenever information changes. The employer withholds wage tax and pension contributions when wages are paid or credited, transfers them from the 1st to the 15th of the following month and submits the monthly WM/CM filing. For a citizen's pension, the worker contributes at least 5% of gross salary and the employer contributes at least 5%. The employer issues a wage or payment statement and records cash payments. Wages are paid at least once per month. The official currency is the euro; the cited 2025 average private-sector wage was EUR 666 gross and EUR 596 net. Full-time work is 40 hours per week. Workers under 18 may work no more than 30 hours per week. Night work runs from 22:00 to 06:00. Overtime is limited to eight hours per week except in an emergency or force-majeure situation, and it is not allowed for workers under 18, pregnant workers, single parents with a child under three or workers caring for a disabled child. The employer keeps overtime records available to the Labour Inspectorate. The work schedule is displayed, and a schedule or schedule-change notice is given at least seven working days in advance. Paid annual leave is at least four weeks, and maternity leave lasts 12 months. Dismissal is prohibited during pregnancy, maternity leave or a special child-care absence except through the collective-dismissal procedure. Occupational health and safety, commonly called Siguria dhe Shëndeti në Punë or SShP, remains the employer's direct responsibility even when outside providers assist. Before engagement, the employer gives written information about risks and protective measures, prepares a risk-assessment document, provides qualified staff or a licensed service, maintains protective and measuring systems, arranges a required medical examination and supplies and maintains personal protective equipment. Fire extinguishers, hydrants and signs have to function. The employer preserves an accident scene and involves workers or their representatives in inspection and investigation. Safety training takes place before work, after a transfer or change of workplace, equipment or technology and periodically thereafter. Extra training applies to safety staff, worker representatives, high-risk workers, managers, supervisors, team leads and people responsible for evacuation, rescue, fire safety or first aid. Regulation 02/2021 supersedes the earlier risk-assessment regulation 03/2014. Construction and industry receive particular practical attention, and the 2026 Labour Inspectorate is digitising case management and strengthening risk-based inspection. Workers may freely create or join unions without the employer's or government's consent. The employer may not disadvantage a worker because of union membership or activity and enables union work through workplace access, notices and publications, necessary time, dues collection and meetings. Employer organisations are voluntary. The Këshilli Ekonomiko-Social (KES) brings together the Government, unions and employer organisations. National employer representation uses criteria that include at least 10% of ATK-registered enterprises and workforce or collective-settlement indicators. Collective Agreements are registered with the MPFVLÇ. The National Council for Occupational Health and Safety is a three-party policy and recommendation body. A union, or one third of the workforce where no union exists, may call a strike. Participation is voluntary, and the employer or authority receives at least seven working days' notice. Social partners can appoint a conciliation commission, which proposes a settlement within seven working days after the dispute begins. A worker first submits a request to the employer or competent employer body. The employer decides within 15 working days and delivers the written decision within eight working days. If the employer rejects the request or does not answer, the worker can bring a labour dispute to court within the following 30 working days. Mediation is available by consent under the Mediation Law. A complaint to the Labour Inspectorate can be submitted at any time within its competence; the Inspectorate decides within 30 working days or sends an extension notice. The employer preserves employment records and evidence and cooperates with inspections. Organisational change can involve economic, technical or organisational reasons, worker incapacity where transfer, training or requalification is unsuitable, or performance and misconduct handled through a written process, a meeting and stated reasons. For indefinite employment, notice is 30 working days after six months to two years of service, 45 working days after two to ten years and 60 working days after more than ten years. A fixed-term contract that is not renewed requires 30 working days' notice; otherwise, the worker may claim an additional 30 days of wages. A collective dismissal covers at least 10% and at least 20 workers within six months. The employer gives workers and any union one month's prior written notice, states the number and categories affected, considers a hiring freeze, internal redeployment, reduced overtime, reduced hours or retraining, and notifies the Employment Office. Severance for an indefinite contract is one monthly wage after two to four years, two after five to nine years, three after ten to 19 years, six after 20 to 29 years and seven after at least 30 years. When an employer changes status or transfers an undertaking, the successor assumes applicable Collective Agreement and contract duties. The predecessor informs the successor and workers in writing; a worker has five working days to respond, and refusal or no response can enable termination. The main cost categories are registration and change services, payroll administration, qualified safety staff or a licensed external service, risk assessment, training, personal protective equipment and fire or medical controls. There is no separate municipal employer regime evidenced beyond national rules and local ARBK service points. Union, collective-bargaining and KES matters are more relevant for unionised, public-sector or larger workforces than for many small employers, while registration, contracts, payroll, safety and inspection remain central for every formal employer.
