Employment in Tonga

Tonga's employment system is fragmented. The reviewed official sources do not show a general Employment Act currently in force; the Employment Relations Bill 2020 remains a bill rather than a complete current regime. Private-sector conditions therefore depend mainly on the employment contract, sector-specific laws and established workplace practice. A current universal minimum-wage rate, universal rules on working hours, leave, notice, severance or private-sector grievance procedures could not be verified in the reviewed sources. The Price and Wage Control Act allows a competent authority to set a minimum wage by order with Cabinet approval, but this does not establish a current rate by itself. The Ministry of Trade and Economic Development (MTED) covers labour-market policy, labour standards, decent work and employment services. Its employment services can register job seekers, match them with vacancies and provide interview briefing, although access is not established as a general mandatory service. Local vacancies may also appear through employers, media and the developing Tonga Employment Network (TEN). Labour statistics recorded 28,603 employed and 650 unemployed people in 2023, with an employment-to-population rate of 44%. In 2021, the statistics recorded 20,941 paid workers and 4,426 subsistence workers. Public-service employment follows separate rules administered by the Public Service Commission (PSC) and government ministries. Vacancies are normally published for at least two weeks and may be internal or external, with PSC clearance where required. Applications commonly include an application letter, curriculum vitae, certified qualifications or transcripts and supporting documents. The PSC handles appointment, promotion, confirmation, discipline, dismissal and employment disputes under the Public Service Act. A person generally has 14 days to appeal a written decision to the relevant tribunal process. A non-Tongan worker who takes employment in Tonga needs an Employment Visa and employment permit, including for short-term work. The application normally requires an employment offer or contract, job specification, repatriation clause, evidence of skills, any required professional licence, a medical report issued within six months, a police clearance issued within three months and two references. Immigration examines the labour-market need, and the employer may need business registration or a licence. Normal processing takes about one month when the application is complete. The employment permit fee is TOP 200 per person per year, while changing from visitor status to employment costs TOP 5,000 per person. Fees are paid before submission and are not refundable. An employer must arrange repatriation at the end of the contract, and changing employers requires a new visa or permit. The Immigration Division and Ministry of Foreign Affairs handle permit functions with labour-ministry support; the planned transfer of overseas-employment administration from the Ministry of Internal Affairs to MTED during financial year 2025/26 was not confirmed in the reviewed material. The National Retirement Benefits Fund (NRBF) provides compulsory retirement savings for insurable employment. The employer and employee register, contributions begin when insurable employment starts and payments are made monthly no later than the end of the month. The statutory minimum contribution is 7.5% of insurable earnings from the employer and 5% from the employee. An employer may deduct the employee share after written notice but may not pass the employer share to the worker. The employer must keep registrations, returns and records. When employment ends, the account becomes inactive or is transferred or paid according to NRBF rules. Workers may register a trade union under the Trade Unions Act. A trade dispute can concern employment, non-employment, employment terms or labour conditions, but the reviewed sources do not verify a comprehensive private-sector dispute-resolution or collective-bargaining structure. Tonga also uses temporary overseas employment pathways. The Recognised Seasonal Employer scheme (RSE) and the Pacific Australia Labour Mobility scheme (PALM) are major routes. The Overseas Employment Division supports registration and superannuation, visas, pre-departure training, worker welfare and communication. The Tonga Labour Mobility Supply Management Strategy (TLMSMS) uses village-based low-skilled and technical-and-vocational-education-and-training pools, screening and skills matching. An overseas employer makes the final recruitment decision, so participation is selective rather than automatic. Return and reintegration programs can affect what happens after overseas employment. The reviewed sources do not establish a direct state unemployment-insurance scheme or a universal termination-benefit equivalent for Tonga.
