Civil law in Belize

In Belize, English common law supplements Belizean legislation where no different rule applies and the adoption is consistent with local circumstances and the court’s jurisdiction. The Constitution is at the top of the legal order. Important statutory foundations concern contracts, the sale of goods, hire-purchase transactions, electronic transactions, land, marriage and family matters, inheritance, liability, and civil procedure. Contracts typically arise through an offer, acceptance, consideration, an intention to create legal relations, and sufficient certainty. Depending on the transaction, a deed, written form, witnesses, registration, or stamp duties may be required. In response to a breach of duty, remedies may include monetary compensation, specific performance, an injunction, rescission, or other legal remedies. Disputes involving consumers or arising from employment relationships primarily belong to related areas of law. Land law distinguishes between registered land and land recorded in another or different way. The land registry (Land Registry), the land titles unit (Land Titles Unit), and the general registry (General Registry) process titles and registrations. Depending on the transaction, transfers, long leases, mortgages, easements, caveats, and subdivisions require deeds, identification documents, plans, and evidence of taxes and fees. Errors in documents, missing survey records, and registry workloads can delay processing. Land disputes generally belong before the High Court. In family law, the Family Court and the High Court handle matters involving children, maintenance, custody, access, guardianship, protection orders, dissolution of marriage, and family property, depending on the proceeding. The best interests of the child are central in proceedings concerning children. A common-law relationship does not automatically have the same property consequences as a marriage; claims depend on the circumstances and the applicable legal principles. Births, marriages, and other civil-status events are recorded through the responsible registry offices. After a death, a will is generally confirmed through probate of a will (Probate of Will). Without a will, an application for letters of administration (Letters of Administration) is usually made; a proceeding with a will attached is also possible. The Supreme Court and the registry process the grant. Only afterward can the executor or administrator generally administer the estate, pay debts, and transfer assets. Formal defects, disputes about validity, creditor claims, and problems with land titles can complicate the process. Liability claims often arise from negligence, interference with property or possession, disturbances of land use, defamation, or breaches of contract. Causation, the extent of loss, contributory responsibility, foreseeability, and mitigation of loss affect the outcome. The limitation legislation (Limitation Act) sets limitation or exclusion periods; evidence, the identity of the opposing party, service, and the applicable period should therefore be examined early. An ordinary civil proceeding follows the civil procedure rules of the senior courts (Senior Courts (Civil Procedure) Rules 2025) and may include a claim, service, a defence, case management, disclosure, witness statements, the taking of evidence, a hearing, and a decision on costs. Family proceedings, non-contentious estate proceedings, and insolvency proceedings may partly follow separate rules. The High Court has broad original jurisdiction in civil matters, the Court of Appeal hears appeals from decisions of the High Court, and the Caribbean Court of Justice is Belize’s final appellate court. The Magistrates Court has only the civil jurisdiction granted by statute. After a money judgment, enforcement measures may include the seizure and sale of goods, instalment payments, an oral examination of assets, garnishment of debts, a charge over property, or enforcement against land, depending on the debtor’s assets. An enforcement order generally remains valid for twelve months and may be extended by no more than six months. A garnishment binds the third-party debtor upon service. Success depends, among other things, on identifiable assets, proper service, priority issues, fees, and the actions of the bailiff. Legal aid under the Legal Aid Act 2023 may, subject to the applicable requirements, be available for matters including family cases, civil cases involving minors, estate proceedings, and land transfers and sales. Court fees, lawyers’ fees, forms, and processing times depend on the proceeding and the current requirements of the responsible authority.
