Romantic relationship in Guinea

Fiançailles are a formal engagement agreement under Guinean law. Each fiancé and each family representative must be represented by at least one witness, but the engagement does not create an obligation to marry. An abusive rupture may give rise to damages. Traditional and religious ceremonies may accompany an engagement or relationship, but their practical and legal effects can differ from a civil marriage. No reliable national evidence establishes one uniform dating pattern, counselling system or cohabitation practice, so regional, ethnic and religious differences should remain explicit. Civil marriage takes place publicly before an officier de l'état civil at the mairie. Marriage under 18 is not allowed, except when a tribunal authorizes it for serious reasons. The consent of both parties must be free and not affected by an error; minors also require approval from parents or the family council. The dot may be symbolic and may consist of money or goods. Marriage formalities can include a residence certificate, a prenuptial certificate, a birth extract and, where applicable, proof concerning the dot or required consent. Publication normally lasts 10 days. The general marriage model is monogamous, but a husband may choose polygamy at marriage with the explicit consent of his wife, up to a maximum of four wives. Consent to marriage is not consent to sexual intimacy. Consent for intimacy must remain present throughout the relationship. Condoms, contraception and testing or treatment for sexually transmitted infections, including HIV, are available through health services and partner clinics, but access and influence over reproductive-health decisions vary by region and social situation. In 2018, modern contraceptive use among married or cohabiting women was about 11 percent. Partner or husband influence over health and family-planning decisions has been documented. Domestic and intimate-partner violence is legally addressed, but enforcement in practice can be weak. In 2018, 21 percent of ever-partnered women and girls aged 15 and older had experienced an indicator of physical, sexual or psychological intimate-partner violence. Sixty-seven percent of women aged 15 to 49 considered wife beating justified for at least one reason, and 76 percent of respondents viewed domestic violence as a family matter. Sixty percent expected criticism, harassment or humiliation after reporting it. A person seeking help can approach a health service, the police or gendarmerie, the justice system or a multisectoral gender-based-violence structure. Stigma, fear, costs and limited cooperation can obstruct access to protection. An unmarried relationship can end informally. Guinean law regulates fiançailles, marriage, divorce and separation of spouses, but does not establish a separate legal status for ordinary dating or cohabitation. A marriage ends through death or a court-declared divorce. Divorce may be based on mutual consent, prolonged breakdown of shared life or fault, and conciliation is required before a claim for certain grounds. Six years of factual separation can support a claim based on prolonged separation. Property, maintenance, children, inheritance and civil-status consequences must be checked separately. A marriage certificate can affect inheritance, birth registration and divorce procedures, and an unmarried relationship should not be assumed to have the same legal effects.
