Employment in Spain

Employment in Spain is commonly called empleo or trabajo por cuenta ajena. The employer organizes the work, while the employee performs agreed duties in return for pay. An employment contract is called a contrato de trabajo. It identifies the parties and should make essential conditions clear, including the role, workplace, working time, pay, start, and contract form. Open-ended employment is known as contratación indefinida. Fixed-duration arrangements are permitted only in appropriate situations, while training and alternating work-study arrangements have their own purposes. A trial period may be agreed when the applicable rules allow it. It must not be treated as a general way to avoid a proper employment relationship. Many jobs are governed by a convenio colectivo. This collective agreement may classify the employee's professional group and supplement general rules on pay, schedules, leave, allowances, and workplace procedures. Employees receive a nómina showing gross earnings, additions, deductions, contributions, and net pay. The employer normally handles payroll withholding and employment-related Social Security registration. Employees have duties such as performing their role, following lawful instructions, observing safety measures, and acting in good faith. They also have rights concerning pay, rest, safety, dignity, equality, representation, and protected forms of leave. Employment can end through resignation, agreement, expiry of a valid temporary arrangement, retirement, or dismissal. The reason, procedure, documents, and final settlement are important, so prompt advice can matter when the ending is disputed.
