As of 6 September 2026, Benin has 12 departments and 77 communes. The Constitution guarantees equality before the law without distinction based on origin, race, sex, religion, political opinion or social position. It protects freedom of thought, conscience, religion, opinion, expression, association, assembly, movement and demonstration, subject to ordre public, meaning public order. It also establishes secularism, protects the inviolability of the home and the confidentiality of correspondence and communications, and recognizes a right and duty to a healthy environment. Women, children, people with disabilities and older people receive constitutional protection. National rules apply throughout Benin, but communes may implement everyday rules differently. The commune is the main local framework for democracy and civic participation. At neighbourhood level, the relevant settings include the voisinage, meaning the immediate neighbourhood, the quartier de ville, meaning an urban quarter, and the village. No nationwide official neighbourhood council or equivalent Maison de justice is evidenced for this subject. People therefore often begin with direct discussion or informal mediation. Depending on the problem, the mairie or mayor, the Police municipale, the Police républicaine or a Tribunal de première instance may become involved. Local police orders and municipal policing can address noise, public hygiene, salubrité, meaning public cleanliness and sanitation, incivilités, public tranquillity, markets, fairs, ceremonies, places of worship, roads, squares, quays, beaches and wandering animals. The commune regulates, authorizes or controls temporary occupation of communal public space. Any related fee depends on the applicable local act rather than on one nationwide tariff. A civil neighbour dispute can proceed from direct discussion to contractual conciliation or mediation and then to court proceedings. A lease contract may provide for conciliation or mediation. The court attempts conciliation, and if it fails, it issues a judgment. An accepted mediation recommendation can have the effect of a court decision. Benin's justice portal lists a civil case filing fee of 10,000 FCFA without stating a filing deadline; this amount is not the total cost of litigation. Mediation access, duration and total civil-proceeding costs are not standardized nationwide. Formal civic engagement can use the constitutional freedoms of association and assembly. Loi 2025-19 introduced the Registre des Associations et Fondations, administered by the Ministère de l’Intérieur et de la Sécurité Publique. A registered association obtains legal personality from its récépissé, the official registration receipt. The process includes declaring the association's existence and later reporting changes to statutes or governing bodies, resources and activities. Foreign associations require authorization, with a dossier that can include statutes, internal rules, identity documents and criminal-record certificates. Article 552 addresses hate or violence linked to race, colour, national or ethnic origin, religion, sexual belonging or disability and provides one year of imprisonment and a 5,000,000 FCFA fine. Article 574 provides penalties of up to five years and 25,000,000 FCFA for violations of private life. Data subjects have rights of access, rectification, deletion and objection. Shared housing belongs primarily to the housing topic. The relevant coexistence boundary is Loi 2022-30 on leases, which allows contracting parties to agree on conciliation or mediation.
