Employment in Belgium

Employment begins when a worker agrees to perform work for pay under an employer’s authority. This authority distinguishes an employee from a genuinely self-employed contractor. The employment contract is called a contrat de travail in French and an arbeidsovereenkomst in Dutch. It identifies the parties and sets the basic terms of the working relationship. A contract can be open-ended, fixed-term, part-time, temporary, or connected to a particular task. Some forms require especially clear written terms, so workers should not rely only on spoken promises. The contract is not the only source of conditions. Legislation, collective labour agreements, sector practices, and the employer’s workplace regulations may add rules about schedules, pay categories, leave, conduct, and procedures. Employees usually receive payslips showing gross pay, deductions, and net pay. Employment also connects the worker to social-security protection, while the employer handles important declarations and payroll deductions. Both sides have duties. The employee must perform the agreed work carefully, while the employer must pay the agreed remuneration and protect health, safety, dignity, and fair treatment at work. Employment may end through resignation, dismissal, mutual agreement, expiry of a fixed term, or another legally recognized event. The correct process and consequences depend on the contract and circumstances, so written records matter. Collective representation is common in Belgian employment relations. Trade unions and workplace representatives can explain sector rules, support consultation, and help workers address problems.
