Immigration law in Azerbaijan

Azerbaijan’s migration system is mainly administered by the State Migration Service, known locally as the “Dövlət Miqrasiya Xidməti.” Border, visa, employment, and other authorities may also have roles depending on the case. Entry permission is the first layer of the system. A traveler may need a visa before arrival, may qualify for another entry arrangement, or may be unable to enter without prior approval. Entry does not by itself grant a right to remain indefinitely or to work. Foreign visitors may need registration at their place of stay through the applicable local process. A hotel may handle this for a guest, while a private host or visitor may need to ensure that it is completed another way. This registration records where the visitor is staying and is not a residence permit. A temporary residence permit allows an eligible person to live in Azerbaijan for an approved purpose. Common legal bases can include family connections, employment, business or investment activity, education, property-related circumstances, and other grounds recognized by law. Permanent residence is a stronger status for people who meet the relevant conditions after developing a sufficient legal connection with Azerbaijan. It is different from citizenship and does not automatically provide every right held by an Azerbaijani citizen. The right to work is a separate question. Many foreign employees require a work permit connected to an employer as well as lawful immigration status, although legal exemptions may apply to particular people or activities. Typical procedures require an application, identity and travel documents, proof of the legal basis, an address, and supporting records. Authorities may check whether documents are genuine, consistent, properly translated, and submitted through the correct applicant or sponsor. Migration problems can arise from overstaying, missing registration, working without permission, using an expired document, or changing circumstances without updating the authorities. Consequences may affect continued stay, departure, future entry, or the employer, so early action is important.
