Crime in Austria

Crime includes many different offenses. These include theft, burglary, fraud, assault, dangerous threats, sexual violence, property damage and certain forms of digital attacks. Not every unfair, disruptive or harmful behavior is automatically a criminal offense. Whether an act is punishable in Austria is determined by criminal law (Strafrecht) and assessed in the specific case by the responsible authorities. The police prevent danger, take reports, secure traces and conduct investigations. In the event of immediate danger or an ongoing attack, the police emergency number (Polizeinotruf) should be called. The public prosecutor’s office (Staatsanwaltschaft) directs the criminal investigation and decides on further legal steps. Courts examine allegations independently and decide on guilt, punishment or other consequences provided by law. A report is the communication of a possible criminal matter to the responsible authorities. It is not the same as a conviction, because information and evidence must first be examined. People affected can secure important information without putting themselves in danger. Useful material includes detailed notes of what they remember, messages, photos of damage, payment receipts, the names of possible witnesses and unchanged digital data. Depending on the circumstances, victims in Austria may be entitled to information, protection and special support. Victim assistance, psychosocial support and legal advice can help people cope with the burden and understand procedural steps. Prevention reduces some risks but does not provide complete protection. Responsibility for a criminal offense lies with the person who commits it, not with the person affected.
